Please read our Terms and Conditions of Use and Privacy Policy carefully because they affect your legal rights.

Introduction

We really appreciate that you want to use Docuspace. Here you have our terms and conditions for using Docuspace and our privacy policies. From now on, we will refer to them as our POLICIES. They de ne the way you have to use the service Docuspace, and also the rights and responsibilities that both you and us have. In order to use Docuspace, you have to agree these POLICIES rst and, once accepted by you, they will act as a contract between you (or the organization that you represent) and Docuex Limited (from now on Daahost), the company that provides Docuspace.

These POLICIES are the complete agreement between you and Docuspace while you use our service Docuspace. This agreement replaces any previous or simultaneously agreement between both parts. This agreement is made exclusively between you and Docuspace, not including any third part, unless it is included in some specific clause.

Docuspace is part of Daahost.com

Docuspace is one of the products included in the Daahost's portfolio of software tools. For using Docuspace or any other product in that portfolio, you need to have a Daahost user account. When signing up in Docuspace, you're in fact creating a Daahost account, and you must accept both the specific terms and conditions of Docuspace and the ones from Daahost. With your Daahost account you'll have direct access to any other Daahost product, not only the ones that exist at the moment you register, but also the products that will be part of Daahost in the future. However, before making use of those products, you'll have to read and accept the specific terms and conditions of that product.

You files are yours

Docuspace allows you upload and store your own digital files. They are yours, just yours. Docuspace will never have any ownership on them, nor any right to use them, except those rights needed in order to provide our service to you.

When uploading files to Docuspace, you have to be sure that your have rights on the content of those files. You shouldn’t upload content of which you don’t have the right to store it, play it or copy it. If uploading and storing those files infringes some copyrights or any other rights, you will be the sole responsible of that infringement.

Permissions that you grant Docuspace

When using Docuspace, you’re granting us permission to perform some actions with your files, like store them, process them, encode them, change their encoding, compress them or make back up copies.

Permissions that you grant to third parties

In case you decide to share your files with other people through Docuspace, whether they have a Docuspace account or not, you will automatically give us permission to share your files and send a copy of those files to the people you decide to share them with. At the same time, you will be giving those people property rights over those copies and you won't be able to control what they decide to do with those copies. In case you decide to make your files available to the public through Docuspace, you'll be automatically granting to anyone the right to download and copy those files. In the event that you make your files public, you'll be loosing control of what people can do with those files, since any person that knows the downloading link of a le will be able to download it.

Your Responsibilities

You are the sole responsible in case you make bad use of Docuspace or use it against the law. You have to follow our rules of good behaviour. Docuspace doesn't have any obligation of evaluating your behaviour and your compliance of our good behavior rules, but we keep the right to evaluate your behavior at any time.

Here you have our rules of good behavior, you will be the sole responsible in case you infringe one or more of them:

  • Do not upload, copy, download and share any content if you don't have the right to do it.
  • Do not upload content that promotes pederasty, terrorism or extreme violence.
  • Do not upload content that promotes hate against people or groups of people because of their race, ethnicity, religion, gender, sexual preferences, or any type of mental of physical disability.
  • Do not try to break or avoid any of the security and authentication measures used by Docuspace.
  • You won't either try to obtain the source code of Docuspace, nor access or change the non-public part of the service offered by Docuspace.
  • You won't use Docuspace to distribute fake news or false accusations about other people or ethnicities.
  • You won't try to avoid paying the fees of our premium subscriptions in case you want to bene t from their features.
  • Do not infringe the rights from other people, whether if they are privacy rights, intellectual rights, property rights or any other right.
  • Do not try to access other people's accounts if they haven't granted you permission to do it.
  • Do not try to do content search inside Docuspace by using techniques that are not the ones offered by Docuspace on its official interfaces.
  • Do not harass, insult or bother other Docuspace users using the features of the service provided by Docuspace.
  • Do not resell the services of Docuspace, unless Docuspace has granted you permission to do it.
  • Do not outrage, harass, attack or harm any member of the staff of Docuspace, its agents or its representatives.
  • Do not use Docuspace with the purpose of infringing any law from your country or those countries where Docuspace operates.
  • Do not do anything that can cause financial damage to Docuspace.

In case you infringe one or more of these rules, Docuspace has the right to suspend preventatively or indefinitely your Docuspace account, and the right to remove any fle from your account.

In case that any legal entity suspects that you are infringing some law from its country, Docuspace has the right to cooperate with that entity and provide the necessary information.

Service interruption

Docuspace puts a lot of effort to provide a great level of service. almost free of interrumptions. However, we can't be 100% sure that our technology won't ever fail and cause interruption of our service.

From time to time, it might happen that our own software could have some errors that could cause a temporary interruption of our service.

Some other times, Docuspace might intentionally shut the service down temporarily to perform maintenance activities or improvements.

In any case, we promise to have our service available 98% of the time per year.

Intellectual property of Docuspace

Docuspace is the owner of all the software developed by Docuspace used to provide our service, that includes the software that corresponds to our public interfaces as well as the backend software that manages, processes and serves the information.

In some cases we use third party software libraries, both private and open source. In those cases, the intellectual property over those libraries doesn't belong to Docuspace, but to whoever it corresponds.

Free service and premium subscriptions

Docuspace can be used for free, allowing users to benefit from a set of functionalities, services and a good amount of limited resources.

Docuspace also offers the possibility to increase those limits in its functionalities, services and/or resources. The user who wants to increase the limit must upgrade his account to a periodically paid subscription. Each one of our premium plans offers a different set of features, services and resources.

In case you hire a periodic subscription, it will be renewed automatically at the end of the period, for the same period of time. At any time within the period of the subscription, the user can cancel the automatic renewal of the service. In that case, the user will be able to keep enjoying all the features of the current subscription until the end of the hired period.

If you paid for a subscription for a period of time, but you don't make use of our services during that period, you won't have the right to get a reimbursement of the money that you paid. When you pay a subscription, you promise not to request a refund once the hired period has started. You will only have the right to request a refund of your subscription in case Docuspace hasn't offered all the features included in the subscription you paid, or in case the service of Docuspace hasn't been accessible during more than 98% of the time of the period.

Corporate accounts

If you create a Docuspace account using an email address that belongs to an entity, organization or a company you work for and at some point you leave that entity, organization or company, that entity, organization or company will have the right to request the suspension of that account.

At the same time, if you create an identifier for your Docuspace inbox using an email address, a phone number or an Internet domain that belongs to an entity, organization or company and you stop being related to it, that entity, organization or company will have the right to ask us to remove that identifier from your inbox, so you will no longer receive voice notes sent to those identifiers.

Suspension of your account

At any time you can cancel your Docuspace account and you don't have to explain your decission to us. We will provide the corresponding mechanism so that you can remove your account, inside your private area of our website, accesible only if you log in with your username and password.

Daahost will only have the right to remove your account if some of these situations happens:

  • If you infringe these terms and conditions or the ones of any other product in Daahost's portfolio, primarly if you infringe our rules of good behavior.
  • If you don't have an active paid subscription and you don't access Docuspace for more than 6 months.
  • If for legal or financial reasons we are forced to close our company and finish our activities.

When removing an account, we will remove all the personal information related to it. But if that account has ever paid a premium subscription, we will keep record of the corresponding payments and a minimum amount of information related with those payments (paid amounts, dates, country where the payment was sent from, etc.). In case an account is removed, either if it's because a user decision or a Daahost decision after infringing our terms, while it has an active paid subscription, the user won't have any right to request a refund of the amount paid and no extra charges will be made in the future.

Cessation of service

In case we are forced to stop offering our services, because of the law or a bad financial situation, we will inform you with enough time, so that you can download all your files before they are deleted from our servers. In case the reason for stoping our service is due to a bad financial situation, we promise to do our best to transfer our assets to a third company, so they can keep offering the service of Docuspace.

What you see is what you get

At Docuspace we work hard for creating a high quality service, free of errors. We put a lot of effort to avoid and fix errors, developing improvements and new functionalities. As far as the law allows it, neither Docuspace, our providers, our distributors or our affiliates can offer any guarantee related with the correct functioning of our services.

The set of functionalities and features offered by Docuspace are the ones that you can find in our interfaces (webs, apps, etc.) at a certain moment. If at any moment, either Docuspace or any of its team members talks about future functionalities or features, that will be just considered as an intention of offering those in the future, but there won't exist any promise from Docuspace to offer them in the future. Primarily if you book a paid subscription, you must understand that you're paying for the services offered at the moment that you are paying, and not for future functionalities or features.

Limitation of liability

We DON NOT limit or exclude our responsibilities with you in those cases where the law doesn't allow it. In some countries, the law allows limiting or excluding certain responsibilities. In that case, in those countries where the law allows it, neither Docuspace, its providers, its distributors or its affiliates will be responsible of:

  • Indirect damage caused by any error or any bad implementation of our services.
  • Service interruption.
  • Data losses.
  • Data robbery by a third party.

In case someone informs about those risks, the team of Docuspace will do everything possible to avoid and stop them as soon as possible, but the limitations and exclusions will remain active.

If you use Docuspace for commercial or business purposes, neither Docuspace, its providers, its distributors or its affiliates will be responsible for any profit loss, pause of business activities, end of the business or commercial opportunities lost. In case the previously mentioned limitation and exclusions can't be applied, the limit of our economical responsibility will be 100% of the amount paid for your active subscription.

If you use Docuspace for free, you are assuming the risks and promise not to ask for economical compensation from Docuspace in case of service errors or damages caused by it.

Disputes resolution

In case either you or us infringe this agreement, both parts will try to reach a friendly solution before taking any legal action against the other part. Before filling any claim or lawsuit against Docuspace, you promise to try to friendly resolve the dispute with Docuspace, contacting us via the email address mail@daahost.com. We will try to resolve the dispute within a period of 15 days from the moment you notify us.

Both parts agree that that court is the judicial seat for resolving any legal dispute. In case the law of your country of residence grants consumers the right to resolve that type of disputes in a local court, this paragraph doesn't invalidate those requirement.

Current law

By general rule, we obey the lay from the United Kingdom. If your country of residence requires that commercial agreements must be regulated by local laws, this clause doesn't annuls those laws.

Future changes in these policies

We will review this agreement periodically and we might make changes, in order to cover some legal aspects not covered in previous versions, adapt our product to law changes, or provide legal coverage to new features or services of Docuspace.

If those changes mean that you have to change the way you use Docuspace, we will send you an email notification to main email address of your Docuspace account, or a notification inside some of our products. Changes will enter into force 30 days after we send the notifi cation. It might happen that for any reason you don't receive the notification. For example, if your email server considers our email as spam and deletes it. In such cases, you will be considered as noti ed, since you are responsible to con gure your email server for not deleting emails sent from Docuspace.

You are free not to accept future changes in our terms of services. In that case, you will have to cancel your Docuspace account and ask for reimbursement of the money that corresponds to the pending period in case you have an active paid subscription.

Account expiration

As you know, the free service of Docusapce allows you to store a big amount of files in our servers. In case you didn't know, storing your files cost us money. We are happy to pay for you your server space, but only if you really want to use Docuspace. So, if you have a free account and you don't really use our services for more than 6 months, we reserve the right to remove your whole account or the files stored under your account.

In case we plan to remove your free account or part of it for not using it for more than 6 months, we will send you a notifications at least 7 days before, just in case you want to avoid your account's removal.
